МВД изменило правила работы регистрационных подразделений ГИБДД с машинами, по тем ли иным причинам лишившимися идентификационных номеров на кузове или раме.
С 10 июля ГИБДД будет по-новому регистрировать машины с поврежденными VIN-номерами. Соответствующий приказ МВД РФ был издан более трех месяцев назад, но вступил в силу только сейчас. Само главное в нем то, что отныне разрешается ставить на учет машины «с измененной маркировкой транспортных средств и номерных агрегатов в результате естественного износа, коррозии, ремонта или возвращенных собственникам или владельцам после хищения, при условии их идентификации».
Ранее получить новые номера или продать такое транспортное средство было невозможно в принципе. Теперь, согласно, разъяснениям полиции, чтобы узаконить исчезнувший (например из-за ржавчины) номер, автовладельцу придется пройти экспертизу по идентификации транспортного средства. И на основании полученного заключения, а также постановления об отказе в возбуждении уголовного дела (а вдруг машина была угнана!), ГИБДД вносит в регистрационные данные пометку, что VIN-номер у машины утрачен.
На самом деле, для автомобилистов принципиально ничего не поменялось. Просто раньше машины с утраченным VIN отправляли на так называемую криминалистическую экспертизу, единственной задачей которой было выявление следов «перебивки» VIN-номеров на кузове и, следовательно, факта угона машины. А сейчас фактически аналогичный процесс назвали иначе. Видимо, чтобы процедура воспринималась гражданами не столь «уголовно».
Куда более интересно другое нововведение в гаишный регламент. Отныне стало возможно «восстанавливать в правах» машину, до того по документам отправленную в утиль. Например, после аварии. Или проданную некогда «по доверенности». Теперь, если машина не была фактически утилизирована, ее регистрацию в ГИБДД можно восстановить «на основании подтверждения учетных данных по месту последней регистрации транспортных средств». Причем в любом регистрационном подразделении полиции любого региона страны.

Но конечно, главное нововведение — это возможность зарегистрировать автомобиль с нечитаемыми идентификационными номерами: если ваш VIN-номер пострадал от ржавчины, естественного износа или последствий ремонта машины, проблем с регистрацией все равно не возникнет.

Приобретение автомобиля с пробегом неразрывно связано с риском возникновения как технических, так и юридических проблем. Последние наиболее часто заключаются в нечитаемости номеров кузова, сохранность которых является залогом успешной регистрации автомобиля в ГИБДД. К сожалению, расторгнуть сделку и вернуть деньги за автомобиль сразу после выявления проблем удается крайне редко. Поэтому человек, планирующий приобретение автомобиля в возрасте, должен быть осведомлен о том, как решать проблемы, связанные с нечитаемостью номеров кузова.
Первоначальные действия при обнаружении проблемы
В абсолютном большинстве случаев автолюбителям удается восстановить проржавевший номер кузова. Дело в том, что цифры выбиты достаточно глубоко в металле. Чтобы они сгнили полностью, требуется длительное воздействие достаточно агрессивной среды. Для того, чтобы восстановить номер, необходимо предпринять следующие меры:
- Смочить тряпку хорошим растворителем и тщательно, с нажимом, протереть место расположения номера кузова. Процедуру можно повторить несколько раз.
- Если протирание растворителем не принесло ожидаемого результата, можно воспользоваться преобразователем ржавчины на основе ортофосфорной кислоты. Для этого препарат наносят на проржавевшую номерную табличку, выжидают 15-20 минут, после чего тщательно протирают обработанное место мокрой тряпкой и сушат. В некоторых случаях на обработанной поверхности начинают заметно проступать цифры номера.
- Если обработки ортофосфорной кислотой оказалось недостаточно, номер можно обработать наждачной бумагой. Однако здесь следует соблюдать определенную осторожность. При должном усердии можно уничтожить и сохранившиеся остатки номера.
На этом все. Пытаться воздействовать на проржавевший участок более агрессивными методами не стоит. Следы слишком активных попыток восстановить читаемость номера могут восприниматься сотрудниками ГИБДД как следы его изменения. Это повлечет за собой возбуждение уголовного дела в отношении человека, который этим занимался.
Не стоит также и продавать данный автомобиль, не сообщив новому владельцу об имеющихся проблемах. В результате можно получить судебный иск, в котором продавец будет обвиняться в мошеннических действиях, изменении номеров кузова спорного автомобиля, умышленном сокрытии имеющихся дефектов.
Прохождение экспертизы
Наиболее разумным вариантом действий при невозможности восстановить читаемость номера кузова автомобиля является прохождение криминалистической экспертизы. Направление на нее выдает инспектор, обнаруживший поврежденный номер при попытке постановки автомобиля на учет. При этом документы на автомобиль у его владельца изымаются.
Для прохождения криминалистической экспертизы владельцу проблемного автомобиля необходимо посетить место ее проведения и взять талон, в котором указана время и дата проведения процедуры. Прибыв на место в указанный срок, водитель оставляет автомобиль у экспертов и дожидается результатов.
Сама экспертиза заключается в том, что с автомобиля снимаются все части, которые ограничивают доступ к поврежденному номеру. При этом работа мастера, который занимается демонтажем, оплачивается из кармана автолюбителя. В отдельных случаях доходит до снятия двигателя. После необходимых подготовительных работ эксперт вытравливает поврежденный номер агрессивными химическими составами. При этом примеси другого металла, неизбежно появляющиеся в процессе переваривания номера, окрашиваются в другой цвет, становясь заметными. Если это произошло, поставить автомобиль на учет становится практически невозможно. По данным экспертизы заводится уголовное дело, в ходе которого выясняют, кто и для чего демонтировал номер кузова. Также производится дополнительная проверка транспортного средства на предмет нахождения в угоне. В дальнейшем поставить такой автомобиль на учет будет нереально. Документы ГИБДД не вернет. Останется только разобрать проблемное транспортное средство или продать целиком на запчасти за символическую стоимость.
В случае если окраски участка номера в другой цвет не выявлено, автолюбителю необходимо дождаться официальных результатов экспертизы, что может занимать до полумесяца. После этого полученные документы подаются в ГИБДД и предпринимается новая попытка постановки на учет. В ПТС при этом делается пометка о том, что номер не был подвержен переделке и сгнил естественным путем.
Возврат собственных денег
При отсутствии возможности поставить автомобиль на учет, необходимо предпринять все меры для того, чтобы получить деньги, потраченные на покупку автомобиля, назад от старого хозяина. Разумно будет в первую очередь обратиться к нему устно, объяснить ситуацию и попытаться решить проблему мирно. Однако далеко не каждый продавец согласиться принять назад проблемное авто (теперь уже и без документов) и вернуть деньги. В таком случае приступают к официальной процедуре обращения в суд.
До суда необходимо составить и отправить продавцу досудебную претензию, в которую включить требование вернуть полную стоимость автомобиля, а также компенсировать расходы, связанные с его транспортировкой и прохождением криминалистической экспертизы. Продавцу предлагается добровольно оплатить досудебный иск и избежать дальнейшего разбирательства.
Если досудебная претензия не принесла результатов, подготавливаются и подаются документы в суд. При этом к сумме иска добавляется госпошлина и другие судебные издержки (помощь юриста). Следует помнить, что даже через суд вернуть можно только ту сумму, которая указана в заключенном между продавцом и покупателем договоре купли-продажи автомобиля. Все средства, уплаченные сверх этого договора, теряются безвозвратно. При покупке автомобиля по генеральной доверенности без дополнительных документов, подтверждающих оплату, вернуть что-либо практически нереально. Именно во избежание подобных ситуаций всякая сделка по купле-продаже автомобиля должна совершаться в форме соответствующего договора, в котором будет указана полная стоимость приобретаемого транспортного средства.
